Reflections Open Competition Terms & Conditions

Inspired by our exhibition Drawn Through Time: Penny McCarthy, Titian and other Time Travellers (9 May – 26 July), Lakeside Arts' Drawing Open, Reflections, is an open application exhibition for UK-based artists working with drawing. See below for the competition's terms and conditions.

Competition General Terms and Conditions

1. The Promoter
The Promoter is: The University of Nottingham, Lakeside Arts , University Park, Nottingham, NG7 2RD.

2. The Competition

2.1 The title of the Competition is Reflections; Lakeside Arts Drawing Open (LADO).

2.2 The Competition is an open submission competition for artists working in drawing. All applications who have paid the application fee will be judged anonymously.

2.3 The artists chosen from the applicants shall receive a prize fee of £200 + £100 towards travel costs, and their work will be displayed as part of a group exhibition at Djanogly Gallery, Lakeside Arts in Summer 2026.

3. How to Enter

3.1 The competition will run from 10.00am on Friday 8th May 2026 (the “Opening Date”) Sunday 21st June 2026 (the “Closing Date”) inclusive.

3.2 All competition entries must be received online by no later than 5pm on the Closing Date. All competition entries received either before the Opening Date or after the Closing Date are automatically disqualified.

3.3 To enter the competition, entrants (“You”) must:
(a) complete an online application form (the “Entry Form”) and submit it through https://www.lakesidearts.org.uk/
(b) make payment of the entry fee of £10 online

3.4 Submission of an entry is only by completion of an entry form and payment of an entry fee online, as detailed above.

3.5 Entries not submitted in accordance with the instructions provided in these terms and conditions shall be deemed invalid and be automatically disqualified. The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.6 By submitting a competition entry, You are agreeing to be bound by these terms and conditions (the “Terms”).

3.8 Please see lakesidearts.org.uk/ReflectionsTCs for a copy of these competition terms and conditions and additionally a copy can be requested at the Promoter Box Office located at Lakeside Arts.

3.9 By submitting Your Work, You confirm that the Work is in a condition to withstand normal rigours of handling and display at Lakeside Arts.

4. Eligibility and conditions of entry to the Competition

4.1 The competition is open to all residents in the United Kingdom.

4.2 Where the entrant is under the age of 18 at the time of entering, they must have the permission from their parent or guardian, who shall provide their details as the prize winner in place of the under 18-year-old for publication in accordance with clause 6.

4.3 In entering the competition, You confirm that You are eligible to do so and eligible to claim the prize You may win. The Promoter may require You to provide proof that You are eligible to enter the competition.

4.4 By submitting Your Work, You confirm that You hold all intellectual property rights in the Work and that You have obtained any third party consents required for the use of third party owned material contained in the Work; that the Work is free and clear of any liens, claims, encumbrances or restrictions, that the use of the Work under these Terms will not infringe upon or violate the rights of any person or entity, and that to the best of Your knowledge and belief the Work has not been exported from any country and shall not be imported into the United Kingdom in violation of any applicable laws or regulations.

4.5 If You do not own all of the rights, title and interest in and to the Work, You must expressly inform Lakeside arts in writing of all relevant details concerning all other third parties’ rights to the Work. You shall indemnify Lakeside Arts against all losses, liabilities, costs and expenses in respect of claims made by third parties alleging partial or total ownership of the Work or any rights in the Work, including intellectual property rights.

4.6 The Promoter will not accept competition entries that are:
(a) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
(b) Are not the original work and sole work of the artist.
(c) All submitted artwork images that meet the criteria will be considered and placed before the selection panel for judging. Judging is carried out anonymously, any image that includes information that may identify the artist as the author will not be displayed to the judging panel.

4.7 There is a limit of one entry per person.

4.8 The Promoter reserves all rights to disqualify You if Your conduct is contrary to the spirit or intention of the prize competition.

4.9 You will not receive a refund of Your fee if You submit work but then decide to later withdraw Your entry. The fee is non-refundable.

4.10 Due to the volume of expected submissions, the selection panel are unable to offer feedback.

5. The prize

5.1 There will be up to eight winners on the discretion of the judges, there shall only be up to eight prizes awarded and no more.

5.2 The only prize is a £200 fee, £100 towards transport and the inclusion in the exhibition at lakeside arts.

5.3 The prize does not include travel insurance, food and drink, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winners.

5.4 There is no cash alternative for the exhibition inclusion prize

5.5 The prize is not negotiable or transferable. The prize may not be sold, offered for sale, coupled or bundled with any other product or services or used for any commercial or promotional purposes whatsoever.

5.6 The nominated selection panel acting on behalf of Lakeside Arts may accept or decline any Work submitted for the Competition or selected for Exhibition entirely at its own discretion. The selection panel’s decision is final.

5.7 Lakeside Arts reserves the right to deny admission or withdraw a Work from the Competition or Exhibition if for any reason the Work, or any circumstances surrounding the display of the Work, appears to Lakeside Arts to expose it to potential or actual damage to its reputation, risk of legal proceedings or enforcement including, without limitation, the alleged breach of third party intellectual property rights.

6. Administration of the prize award

6.1 All applicants shall be made aware of the outcome by the 1st of July 2026.

6.2 The Promoter will contact the winners using email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.

6.3 In order to claim the prize, the selected winner must respond to the email notifying them of being selected within 7 calendar days of receipt of the notification email, failure to do so results in withdrawal of the prize.

6.4 The decision of the Promoter is final, and no correspondence or discussion will be entered into.

6.5 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the names of the prize winners to anyone who emails lakeside-marketing@nottingham.ac.uk

6.6 If You object to any or all of Your surname, and winning entry being published or made available, please contact the Promoter lakeside-marketing@nottingham.ac.uk. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7. Claiming the prize

7.1 If You are the winner of the prize, You shall ensure that You respond to the notification email sent by the Promotor within 7 calendar days of receipt of the notification email.

7.2 The prize may not be claimed by a third party on Your behalf.

7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 10 of days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

7.4 Once the Prize has been administered, the Promoter may seek permission from the Winners to share the Winner’s name and social media handles on its Instagram, Facebook and Twitter accounts and press releases as well as its official website and its internal channels.

7.5 The Promoter does not accept any responsibility if You are not able to take up the prize.

8. Data protection and publicity

8.1 The Promoter will only process Your personal information as set out in the Privacy Notice – Lakeside Arts, Nottingham. See also condition 6.5 and condition 6.6, with regard to the announcement of winners.

9. Competition Prize Winners’ Terms and Conditions

9.1 These terms and condition as set in clauses 9 to 17 apply to all winners selected by the selection panel to exhibit their Work as part of a group exhibition at Djanogly Gallery, Lakeside Arts in Summer 2026 (“the Exhibition”). In taking up the prize, You agree to be bound by these terms.

9.2. When working with us, You and the art works that you submit must comply with all relevant health and safety statutes, safety announcements, and Venue regulations. You agree to indemnify Lakeside arts, its staff and visitors to the Exhibition for any loss, damage, cost, or expense which results or arises from a breach of such standards and regulations.

10. Sale of Work (Applicable to all Types of Sales) and Lakeside Arts Commission

10.1 The sale of any Work exhibited in the Exhibition by You will be subject to a payment of 50% commission (“the Commission”) plus the standard prevailing rate of VAT due to Lakeside Arts.

10.2 The Commission will be charged on the gross sales price of such Work.

10.3 Payment for an artwork will be received in full at the time of purchase and not in the form of any deposit or staggered payment.

10.4 All monies are retained until the end of the exhibition for reconciliation and review. After the exhibition ends, any reimbursement of a sale will be made. The amount paid to the artist will be the gross sale of the work less Commission plus the standard prevailing rate of VAT. Payments will be made in line with Lakeside arts financial processes and procedures.

11. VAT

11.1 In the sale of works, Lakeside Arts is acting as the agent on behalf of the artist, it will be the responsibility of the artist to disclose the VAT to HMRC if it is applicable. Lakeside Arts will charge the standard prevailing rate of VAT on the sales commission.

12. Distance Sales

12.1 Sales can on only be processed in person.

12.2 All purchases must be collected in person. No postage is possible.

13. Delivery and collection of exhibited work

13.1 You will be informed of the specified period in which Your Work must be delivered to Lakeside Arts.

13.2 Works should only be delivered to Lakeside arts if they have been selected for presentation by the selection panel and after You have received specific instruction to do so from Lakeside Arts. Notification will be sent by email requesting that Your work be delivered on a specified day.

13.3 Lakeside Arts will provide each winning artist with £100 towards total transportation costs.

13.4 You are responsible for all other transportation costs above £100.

13.5 Delivery and collection transportation will not be organised by Lakeside Arts and expenses associated with transportation above £100 will be covered by You.

13.6 No Work that has been accepted and displayed at the Exhibition may be removed prior to the end of the Exhibition.

13.7 You will be informed of the specified period in which Your Work must be collected from Lakeside Arts. To collect the work, You will need to present photographic proof of I.D.

13.8 If any unsold Work has not been removed within three months of the final collection date for exhibited works, the Work will be deemed to have been abandoned by You and Lakeside arts shall be entitled, without notifying You, to sell or otherwise dispose of such Work and to use the proceeds of the sale to cover any outstanding charges.

13.9 If any Work that has been sold has not been removed by the Purchaser within three months of the final collection date for exhibited works, You will arrange for the Work to be collected from Lakeside arts and You will be responsible for any transportation costs.

14. Intellectual Property Rights and Consent

14.1 By submitting a Work, You confirm that either You or the Artist hold all intellectual property rights in the Work and that You or the Artist have obtained any third-party consents required for the use of third party owned material contained in the Work.

14.2 By submitting a Work, You consent to Lakeside Arts and the University of Nottingham for the following purposes:
(i) taking an image of, filming or making available the whole or any part of the Work, including but not limited to the right to include the Work in any broadcast (and rebroadcast) by any broadcaster (including the BBC) and any licensees of any broadcaster;
(ii) filming, broadcasting and/or reproducing the whole or any part of the Work for archival, educational, publicity and marketing (including without limitation on the Website, Exhibition posters, leaflets, private view cards, postcards and all forms of social media), press, signage, gallery guide and for catalogue purposes; and
(iii) reproducing the whole or any part of the image which You have supplied to us for the purposes set out above.

14.3 By submitting a Work, You agree that members of the public will be allowed to take photographs of the Work (alone or in combination with other works) for personal and non-commercial use during the Exhibition period. Lakeside Arts will install notices in the Exhibition indicating that photography is permitted provided it is for personal and non-commercial use. The Promoter will not be responsible if any such images of the Work are exploited commercially in violation of the permission given, and in such circumstances, it is up to the Artist and/or You to defend Your intellectual property rights in the Work.

14.4 The consent set out in Clause 14 is irrevocable and given without payment of any fee or royalty and includes consent to make available the Work in all media (including without limitation all forms of electronic and social media) for perpetuity and on a world-wide basis.

15. Framing and Glazing

15.1 For all two-dimensional submitted works, framing is preferred. Metal, glass and Perspex clip frames are not acceptable.

15.2 In the event that You choose to submit an unframed work, it will be strictly at Your own risk. Methods of wall application (pins, adhesive) are likely to result in damage to the surface of the work. Submission without a frame presumes Your implied consent to such.

15.3 Lakeside Arts may need to affix attachments to the frame should Your work be selected for the Exhibition. Existing attachments may be removed if required.

15.4 Works that are comprised of more than one part must be clearly identified as a single work.

15.5 We suggest that You add soft padding to all corners of Your work for transportation.

16. Ineligible Work

16.1 The following types of work are ineligible: Works that contain noxious or toxic substances, have flammability below 50°C, contain human tissue, or incorporate dangerous electrical appliances. Note: all electrical appliances must be accompanied by current PAT test certification.

17. Limitation of Liability

17.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

17.2 The Promoter shall have no liability to You or the Artist whatsoever for any loss of business or profits, loss or damage to reputation, or for any indirect or consequential loss or damage of whatever nature, howsoever caused, whether occurring in contract, tort (including negligence) or otherwise arising out of or in connection with the Exhibition.

17.3 The Promoter shall not be liable for any deterioration or wear and tear to the Work, or any loss, damage or destruction (including damage to frames) through the ordinary course of handling the Work whether included in the Exhibition.

17.4 The Promote will only be liable for damage to a Work arising directly from the Promoter’s actions or negligence, and only to the extent that such damage arises while the Work is in the care, custody and control of Lakeside Arts, which is only while the Work is at Lakeside Arts. If You suspect any such damage, You must notify Lakeside Arts before the Work is collected otherwise Lakeside Arts will not be liable for any such damage.

17.5 Nothing in these Terms shall have the effect of limiting or excluding either party’s liability to the other for death or personal injury caused by its own negligence or caused by its fraud (including fraudulent misrepresentation).

17.6 Subject to Clause 17.5, the entire liability of Lakeside arising out of or in connection with the Exhibition, whether in contract, tort (including negligence or breach of statutory duty) or otherwise, shall not exceed the value of the £200 prize fee.

17.7 If Lakeside Arts disputes the value of the Work or the amount of the damage to the Work, the dispute as to the value or the amount shall be referred, independently of any issue as to liability, to an expert independent valuer to be chosen by Lakeside Arts provided that the valuer’s determination shall not exceed Lakeside arts maximum liability in accordance with Clause 17.6. The valuer shall act as an expert and not an arbitrator. The valuer’s decision shall be final and shall be conclusive evidence of the value of the Work or the amount of the damage to the Work. The valuer’s costs will be borne equally between Lakeside Arts and You. You shall not be entitled to begin or maintain any action in respect of any damage until the valuer has made a decision in accordance with this clause as to the value of the damage and such action shall then be only for the amount determined by the valuer, again subject to Lakeside Arts maximum liability.

18. General

18.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude You from participating in the competition.

18.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

18.3 No third party shall have any rights under or in relation to the Terms.

18.4 For the purposes of these Terms, a Force Majeure Event means an event beyond the reasonable control of Lakeside Arts including but not limited to strikes, failure of a utility service or transport network, act of God, terrorism, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors. The promoter shall not be liable to You under these Terms as a result of a Force Majeure Event.

19. Entire Agreement
These Terms contain the whole agreement between the parties relating to the subject matter of this agreement at the date hereof to the exclusion of any terms implied by law which may be excluded by contract. Each of the parties agrees that it has not entered into these Terms in reliance on any representation, warranty, undertaking or other statement, expressed or implied, orally or in writing, given or made by or on behalf of the other party except in so far as contained in these Terms. This clause shall not apply to any representation, warranty, undertaking or statement made fraudulently or which was induced by fraud.

20. Governing law and jurisdiction
These Terms and the contract of which they form part shall be governed by and construed in accordance with English law. Any disputes arising in relation to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
